Employers must notify workers of possible premium assistance

Employers providing group health insurance in states with premium assistance through Medicaid or the Children’s Health Insurance Program (CHIP) must provide annual notice of that assistance before the start of each plan year.

The notice explains how employees can find out if premium assistance is available, and how to apply for Medicare or CHIP coverage for dependents.

Pay data reporting rule suspended

Employers no longer required to submit pay information in EEO-1 reporting

New wage reporting rules have been suspended by the White House Office of Management and Budget, a relief for many employers gearing up for compliance with the new requirements.

The EEO-1 pay reporting requirements would have required employers with 100 or more employees to submit detailed W-2 pay data across a variety of wage ranges and other items including race, gender and ethnicity.

This is good news for employers who were planning to make costly changes to their HR technology and payroll software to collect and submit the required data points.

Repeal talk doesn’t minimize potential for penalties

Though the Senate has been unable to pass an Affordable Care Act repeal bill so far, many legislators say they are not giving up. An ACA repeal could loosen a number of regulations for employers, but organizations should not assume repeal is imminent.

While it is important to monitor Congress’ actions around repeal or deregulation, employers must remain critically aware that the ACA is in place, and carries stiff penalties for noncompliance. Keep an eye toward Washington, but focus on compliance today, because the possibility of repeal does not affect the penalties today.
